Obtaining a Grant of Probate for someone who has died leaving a Will
Obviously when someone dies this is a difficult time for all concerned. Not only is there the emotional stress to cope with but also the legalities involved in obtaining a Grant of Probate.
What is a Grant of Probate and why is it needed?
A Grant of Probate is obtained from the Probate Registry. It is a sealed court document that confirms the power of the executor appointed in a Last Will and Testament to administer an estate. This document is needed to prove the authority of the executor to liquidate assets sell real estate and settle liabilities and make a statutory notice. Without the Grant of Probate the appointed executor cannot do this.
As part of the service we offer we can assist you in obtaining the Grant of Probate after which you can if you wish proceed to administer the estate of the person who has died according to the wishes set out in the Will without further recourse to us. This service is usually done on a fixed fee basis.
